TERMS AND CONDITIONS

1. ABOUT THESE TERMS
These Terms and Conditions (“Terms”) govern access to and use of the YouFinder website and participation in retreats, socials, festivals and related experiences offered under the YouFinder brand (“Experiences”). YouFinder is operated by Experiential Living Projects Private Limited (“Company”, “YouFinder”, “we”, “us” or “our”). By accessing the website, submitting an application or registration, making a booking or payment, or participating in an Experience, you agree to these Terms.
2. ELIGIBILITY AND INFORMATION
Unless a specific Experience expressly states otherwise, participation is limited to persons aged 18 years and above. You must provide accurate, current and complete information and promptly inform us of any material change relevant to your participation, health, safety, accessibility or booking. We may decline or cancel an application or booking where eligibility requirements are not met, information is materially inaccurate, or participation may reasonably create a safety or operational concern.
3. NATURE OF EXPERIENCES
Each Experience is different. Dates, duration, location, accommodation, inclusions, exclusions, capacity, activities, facilitators and participation criteria are those stated on the applicable Experience page or written confirmation. Illustrations, sample schedules and descriptions are indicative unless expressly confirmed. We do not promise any particular personal, professional, therapeutic, social or emotional outcome.
4. APPLICATIONS, REGISTRATION AND CONFIRMATION
Submitting an enquiry, application, interest form or registration does not by itself create a confirmed booking. Participation is subject to acceptance, availability, any applicable screening, full payment and written confirmation from the Company. We may place applicants on a waitlist or request further information before confirmation.
5. PRICES, TAXES AND PAYMENT
The amount payable, applicable taxes, instalment terms and payment deadline will be disclosed before payment. A booking is not confirmed until the required payment has been received and acknowledged. You are responsible for bank charges, payment-provider charges or taxes expressly disclosed at checkout or in the written booking terms.
6. CANCELLATION, REFUNDS AND TRANSFER TO THE NEXT EDITION
All completed sales are final and non-refundable, except where a refund is required by applicable law or where the Company cancels an Experience and does not offer a reasonable alternative.
If you cannot attend, the amount paid may be transferred as credit to the next announced YouFinder edition, subject to all of the following conditions: you give written notice before the scheduled start date of the original Experience; places remain available in the next edition; you meet any participation or screening requirements applicable to that edition; you pay any difference if the next edition costs more; and the Company confirms the transfer in writing. If the next edition costs less, no cash balance or refund will be payable. The credit has no cash value and cannot be exchanged for a refund.
Failure to attend, late arrival, early departure, removal for misconduct, or inability to participate for personal, travel, health, documentation or scheduling reasons does not create a right to a refund. Statutory rights that cannot lawfully be excluded remain unaffected.
7. TRANSFER TO ANOTHER PERSON
A booking may be transferred to another person only with the Company’s prior written approval. The proposed replacement participant must provide required information, satisfy applicable eligibility or screening requirements, accept these Terms and pay any reasonable administrative or price difference communicated in advance. The Company may refuse a substitution for safety, eligibility, capacity or operational reasons.
8. CHANGES OR CANCELLATION BY THE COMPANY
We may make reasonable changes to the schedule, venue, accommodation, route, facilitators, hosts, activities or format because of safety, weather, availability, operational requirements or circumstances beyond our control. We will communicate material changes as reasonably practicable. If the Company cancels an Experience, we may offer transfer to another edition, a credit or another reasonable alternative. A refund will be provided only where required by applicable law or where the Company cancels the Experience and does not offer a reasonable alternative.
9. TRAVEL, DOCUMENTS AND INSURANCE
You are responsible for arranging and paying for travel to and from the Experience unless expressly included, and for holding valid identification, permits, tickets and other documents. You are responsible for arriving on time. We strongly recommend suitable travel, health, personal accident and cancellation insurance for retreats and travel-related Experiences.
10. HEALTH, ACCESSIBILITY AND PERSONAL RESPONSIBILITY
You must disclose information reasonably necessary for safe participation and notify us of relevant dietary, allergy, health, medication, mobility or accessibility requirements before the Experience. You remain responsible for deciding whether an activity is appropriate for you and may opt out of an activity. YouFinder Experiences are not medical care, psychotherapy, crisis support or a substitute for professional advice. In an emergency, we may contact your emergency contact or appropriate services.
11. CONDUCT, SAFETY AND CONSENT
Participants must treat other participants, staff, hosts, venues and local communities with respect; follow reasonable safety and venue instructions; respect personal boundaries and consent; and refrain from harassment, violence, discrimination, unlawful activity, dangerous conduct or material disruption. We may refuse participation or remove a person where reasonably necessary for safety, welfare, consent, legal compliance or the integrity of the Experience. Removal for misconduct does not create a right to a refund or transfer.
12. ASSUMPTION OF RISK AND LIMITATION OF LIABILITY
Travel, outdoor activity, physical movement, unfamiliar environments, shared accommodation, food and interaction with other participants involve inherent risks. You accept the ordinary risks reasonably associated with the Experience and remain responsible for your personal property and decisions. To the maximum extent permitted by law, the Company will not be liable for indirect, incidental, special or consequential loss, or for loss caused by your conduct, inaccurate or withheld information, third parties or circumstances beyond our reasonable control. Where liability cannot lawfully be excluded, the Company’s aggregate liability will, to the extent permitted by law, be limited to the amount you paid for the affected Experience. Nothing in these Terms excludes liability or consumer rights that cannot lawfully be excluded or limited.
13. THIRD-PARTY PROVIDERS
Accommodation, transport, food, venues, activities and payment services may be provided by independent third parties. Their terms and safety rules may apply in addition to these Terms. We select and coordinate providers with reasonable care but are not responsible for acts or omissions outside our reasonable control, subject always to non-excludable rights under applicable law.
14. PHOTOGRAPHY, VIDEO AND MEDIA
Photography, video or audio may be captured during an Experience. We will request or communicate consent arrangements separately where identifiable content may be used for promotional, editorial or archival purposes. Please notify the team before the Experience if you do not wish to appear in identifiable media. We will use reasonable efforts to respect stated opt-out preferences, subject to crowd scenes and incidental background capture.
15. INTELLECTUAL PROPERTY
The YouFinder name, branding, website content, programme materials, designs, text, graphics and other intellectual property belong to the Company or its licensors and may not be copied, reproduced, adapted, distributed or commercially used without prior written permission. You retain ownership of content you create, subject to any separate permission you grant us.
16. PRIVACY
Personal data is handled in accordance with the YouFinder Privacy Policy, which forms part of these Terms.
17. FORCE MAJEURE
We are not responsible for delay, change or non-performance caused by events beyond our reasonable control, including severe weather, natural disaster, epidemic, pandemic, government action, civil disturbance, transport disruption, venue unavailability, labour disruption, utility failure or similar event. We will take reasonable steps to communicate and offer a practical alternative where possible, subject to applicable law.
18. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of India. Subject to any mandatory consumer forum, statutory remedy or jurisdiction that cannot lawfully be excluded, the courts of competent jurisdiction in Himachal Pradesh shall have exclusive jurisdiction over disputes arising from or relating to these Terms or an Experience.
19. COMPLAINTS AND GOOD-FAITH RESOLUTION
If you have a complaint, please contact us promptly with sufficient detail so that we can review it. The parties will first attempt in good faith to resolve the matter directly, without limiting any right to approach a competent authority, consumer commission or court.
20. GENERAL
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver. These Terms, the applicable Experience page, the written booking confirmation and any policies expressly incorporated by reference constitute the agreement relating to the booking. If there is an inconsistency, the specific written booking confirmation for the relevant Experience will prevail to the extent of that inconsistency, subject to applicable law. We may update these Terms for future bookings by posting a revised version with an updated date.
